Cases We Handle

The attorneys at Kalikhman & Rayz, LLC can handle a wide variety of personal injury claims, including those involving:

  • Car accidents – We assist motor vehicle accident victims with first- and third-party auto insurance claims and car accident lawsuits.
  • Motorcycle accidents – Motorcycle accidents can cause devastating injuries because bikes lack the protections offered by a vehicle’s cab. We help injured riders get the resources they need to heal.
  • Truck accidents – Truck accident claims can be complex because they often involve commercial entities and multiple liable parties. Our firm has extensive experience with these types of cases and the relevant laws, including federal trucking regulations.
  • Pedestrian accidents – Drivers have a duty to watch for pedestrians and bicyclists and share the roadways with them according to state laws. We can hold motorists liable for negligence if their actions hurt you or someone you love.
  • Slip and fall accidents – If you suffered a slip, trip, and fall injury caused by negligent or dangerous property conditions, our lawyers can prove that the property owner or manager is liable for your damages.
  • Premises liability – In addition to slip and falls, we handle other premises liability issues, including dog bite injuries, swimming pool accidents, balcony or deck collapses, and negligent security incidents.
  • Wrongful death – If your loved one’s personal injury was fatal, we can assist qualifying survivors with a wrongful death claim.

Many injury victims believe they can handle their claims alone but then find themselves overwhelmed by insurers. They may even accept an offer that is far from fair, leaving them without enough compensation to cover their needs. No matter how simple a case may seem on the surface, we encourage you to reach out to our team to explore your legal options.

How to Prove Liability for a Personal Injury

Proving liability for personal injuries requires building a case based on the four elements of negligence:

  1. Duty of care – In any given situation, people have a legal obligation to act reasonably and avoid harming others. For example, motorists have a duty to drive safely and prevent accidents.
  2. Breach of duty – A person breaches the duty of care when they break the law or behave in a way most others would not find reasonable or necessary.
  3. Causation – Causation shows how a liable party’s breach of duty led to an injury. In a car accident case, our attorneys may demonstrate that the liable party was texting and driving, causing them to cross the center line and hit another vehicle, resulting in a back injury.
  4. Damages – Damages establish that a victim’s injury caused them financial losses, pain and suffering, and they have the right to recover compensation.

We Do the Work While You Rest and Recover

While you focus on recovering, our attorneys will focus on constructing a solid personal injury case supported by evidence. We can:

  • Visit the accident scene to take photographs and videos and collect physical evidence
  • Obtain police reports, medical records, and other relevant case documents
  • Locate and interview eyewitnesses
  • Locate available surveillance footage of the accident
  • Send spoliation letters to involved parties demanding evidence in their possession, like truck driver logs or property maintenance records
  • Hire and consult experts, such as medical experts or accident reconstruction specialists, when needed.

Pennsylvania Laws That Can Affect Your Case

Several Pennsylvania laws can affect a personal injury claim, including:

Modified Comparative Negligence

Pennsylvania follows a modified comparative negligence system, outlined in 42 Pa. C.S.A. § 7102. According to the law, when determining personal injury compensation, the court will consider each party’s degree of liability for the accident. If the court assigns the victim a percentage of fault, it can reduce damages by the corresponding amount.

So, if someone has $100,000 in losses but are 15 percent responsible, they could receive $85,000. Those who are more than 50 percent at fault cannot recover any compensation. This law can affect insurance claims even if victims do not go to court. If necessary, our attorneys can defend against allegations that blame you for your injury in order to reduce your damages.

Statutes of Limitations

The statute of limitations dictates how long you have to file a personal injury or wrongful death case in civil court. According to 42 Pa. C.S.A. § 5524(2), the deadline in Pennsylvania is two years. If time runs out, the court will usually bar you from taking legal action. If you cannot sue, you also lose your leverage over the insurance company.

“Choice” No-Fault Auto Insurance

If your personal injury occurred in a motor vehicle accident, your case will likely involve an auto insurance claim. The type of insurance you carry will determine the damages you can recover.

According to the Pennsylvania Department of Insurance, drivers get to choose whether they want full or limited tort coverage. Depending on the coverage, drivers may not be able to seek certain damages, including pain and suffering, unless they have a severe injury as defined by Pennsylvania law. These laws can complicate already difficult claims, and our team is prepared to handle these nuances.
